1. Acceptance of Terms
Welcome to Top Time! These Terms of Service ("Terms") govern your access to and use of the Top Time mobile application (the "App") and related services (collectively, the "Services") provided by Top Time ("we," "us," or "our").
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms in the App and updating the "Effective Date" above. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
2. Eligibility
You must be at least 13 years old to use our Services. By using the App, you represent and warrant that:
- You are at least 13 years of age
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations
- All information you provide is accurate and complete
If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Account Registration and Security
To use certain features of the App, you must create an account by providing:
- Your phone number (for OTP verification)
- Your full name
- Optional: email address, delivery address, vehicle information
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activities.
4. Orders and Payments
4.1 Placing Orders
When you place an order through the App:
- You are making an offer to purchase the selected items
- We reserve the right to accept or reject your order for any reason (e.g., item unavailability, pricing errors, suspected fraud)
- Order confirmation does not guarantee acceptance; acceptance occurs when we begin preparing your order
- All orders are subject to availability
- We reserve the right to limit order quantities
4.2 Pricing and Payment
- All prices are listed in UAE Dirhams (AED) and include applicable VAT
- Prices are subject to change without notice
- We accept payment via Apple Pay, Google Pay, credit/debit cards, and cash at pickup
- Payment is processed at the time of order placement (except for cash payments)
- You authorize us to charge your selected payment method for the total order amount
- Payment processing is handled by third-party payment gateways; we do not store your full card details
4.3 Order Modifications and Cancellations
- You may cancel or modify your order within 2 minutes of placement by contacting the branch directly
- Once order preparation has begun, cancellations may not be possible
- Refunds for cancelled orders will be processed within 5-7 business days
- We reserve the right to cancel orders due to item unavailability, pricing errors, or other unforeseen circumstances
- If we cancel your order, you will receive a full refund
5. Pickup and Delivery
- Top Time offers pickup service only (in-store pickup and curbside pickup)
- Estimated preparation times are approximate and not guaranteed
- You will receive push notifications when your order is ready
- For curbside pickup, please provide accurate vehicle information
- Orders not picked up within 30 minutes of the ready notification may be cancelled without refund
- You are responsible for checking your order upon pickup; report any issues immediately
6. Loyalty Rewards Program
- Our loyalty program allows you to earn points on eligible purchases
- Points can be redeemed for discounts on future orders
- Points have no cash value and cannot be transferred or sold
- We reserve the right to modify or terminate the loyalty program at any time
- Points may expire after a period of inactivity (to be specified in program terms)
- Fraudulent activity may result in forfeiture of points and account termination
7. Coupons and Promotions
- Promotional offers and coupons are subject to specific terms and conditions
- Coupons may have expiration dates and usage limits
- Only one coupon may be used per order unless otherwise specified
- Coupons cannot be combined with other offers
- We reserve the right to cancel or modify promotions at any time
- Fraudulent use of coupons may result in account termination
8. User Conduct and Prohibited Activities
You agree not to:
- Use the App for any illegal or unauthorized purpose
- Violate any local, national, or international laws
- Infringe upon the rights of others
- Transmit any harmful code, viruses, or malicious software
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the App or servers
- Use automated systems (bots, scrapers) to access the App
- Impersonate any person or entity
- Harass, abuse, or harm other users or our staff
- Submit false or misleading information
- Engage in fraudulent activities or payment disputes
- Resell or commercially exploit our Services without permission
Violation of these terms may result in immediate account termination and legal action.
9. Intellectual Property Rights
All content, features, and functionality of the App, including but not limited to:
- Text, graphics, logos, images, and icons
- Software, code, and algorithms
- Trademarks, service marks, and trade names
- Design, layout, and user interface
are owned by Top Time or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any copyright, trademark, or proprietary notices
- Use our trademarks or branding without written permission
10. User-Generated Content
When you submit ratings, reviews, or other content through the App, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and promoting our Services.
You represent and warrant that:
- You own or have the right to submit the content
- Your content does not violate any third-party rights
- Your content is not defamatory, obscene, or offensive
- Your content complies with all applicable laws
We reserve the right to remove any content that violates these Terms or is otherwise objectionable.
11. Disclaimers
THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the App will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, reliability, or completeness of content
- Warranties regarding food quality, taste, or suitability for dietary restrictions
We do not guarantee:
- Availability of specific menu items
- Accuracy of estimated preparation times
- Uninterrupted access to the App
- Compatibility with all devices
You use the App at your own risk. We are not responsible for:
- Food allergies or dietary restrictions (please inform staff of any allergies)
- Third-party payment processing issues
- Device compatibility or technical issues
- Loss of data or content
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOP TIME AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Personal injury or property damage arising from your use of the Services
- Any damages exceeding the amount you paid to us in the 12 months preceding the claim
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Top Time and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the App or Services
- Your violation of these Terms
- Your violation of any rights of third parties
- Your violation of any applicable laws or regulations
- Content you submit through the App
14. Dispute Resolution and Governing Law
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.
14.2 Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services:
- Informal Resolution: You agree to first contact us at support@toptime.cafe to attempt to resolve the dispute informally
- Mediation: If informal resolution fails, the parties agree to attempt mediation before pursuing litigation
- Jurisdiction: Any legal action shall be brought exclusively in the courts of the United Arab Emirates
- Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions
15. Termination
We reserve the right to suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent or illegal activity
- Abusive behavior toward staff or other users
- Non-payment or payment disputes
- Prolonged inactivity
Upon termination:
- Your right to use the App will immediately cease
- We may delete your account and data
- You remain liable for any outstanding payments
- Provisions of these Terms that by their nature should survive termination will remain in effect

16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Top Time regarding the use of the Services and supersede all prior agreements and understandings, whether written or oral.
